Types of Employment Contracts in Mexico

In Mexico, there a two main types of employment contracts which cover different circumstances:

This is the least common type of employment in Mexico. This is for temporary or specific projects that have a defined end date. E.g. temporary work, seasonal employment, project-based wo.

This is the most common type of employment contract in Mexico. The workers’ employment has no specific end date and continues until either the employer or employee decides to terminate the role, following legal procedures.

 

Other employment contracts include:

  • Contrato a prueba (Trial Period Contracts): This is a trail period of up to 30 days, where employers evalute the employees performance (180 days in some cases).
  • Contrato de capacitacion inicial (Training Contracts): This is aimed to train new employees and these contracts can last up to 3 months.

 

Employment Benefits in Mexico

Mexican employers are entitled to various benefits, including paid time off, sick leave, and parental leave. Notice periods vary depending on the length of service, and there are strict rules regarding termination. Employers must also provide their employees with a Christmas bonus, called Aguinaldo, also known as the 13th Month Salary.
